This site, www.DoctorKnow.ai, and any associated mobile app, are owned and operated by Jeffrey Charles Gillen, owner of www.MindcandyBranding.com®.
"DoctorKnow.ai" and the accompanying heart logo (the "Marks") are trademarks of Jeffrey Charles Gillen. Trademark law protects the Marks as identifiers of our site; to the extent the logo's artwork is sufficiently original, its design may also be separately protected under copyright law. You may not adopt the Marks as your own primary brand, name, or logo on another site or product. You're welcome to reference or reproduce the Marks elsewhere — for example, to link to or credit DoctorKnow.ai — provided you include a visible, working link back to www.DoctorKnow.ai and don't suggest that your site is DoctorKnow.ai or is endorsed, sponsored, or operated by us.
Use of Other Companies' Trademarks on This Site
DoctorKnow.ai is an independent, informational and commentary site. In the course of comparing, reviewing, and discussing AI models and the companies that build them, we refer to — and sometimes display — the names and logos of those companies.
This isn't covered by a "Fair Use Act," because no such law exists. What actually permits it is a doctrine U.S. courts have developed called nominative fair use, first laid out by the Ninth Circuit in New Kids on the Block v. News America Publishing, Inc., 971 F.2d 302 (9th Cir. 1992), and refined in later cases like Playboy Enterprises, Inc. v. Welles, 279 F.3d 796 (9th Cir. 2002). Under this doctrine, a company or trademark can be referenced without the owner's permission when three conditions are all met:
- The company, product, or service being discussed cannot reasonably be identified without using its name or mark — there's no other way to compare "ChatGPT" to "Gemini" than by naming them.
- Only as much of the mark is used as is reasonably necessary to identify it — typically the name in plain text, rather than an unnecessarily large or stylized reproduction of a logo.
- Nothing about the use suggests the trademark owner sponsors, endorses, or is affiliated with DoctorKnow.ai.
We rely on this doctrine, and only within these limits: our references to other companies' names and marks are made strictly to identify, describe, and compare them — never to imply their endorsement of us, and never to pass our site off as affiliated with them. All third-party trademarks, logos, and brand names on this site remain the property of their respective owners.
